ForumPay’s New Payment Flow: Bridging Rails or Shifting Risk?

A merchant accepts a Visa card for a $100 sale. No chargeback liability. No PCI-DSS compliance. No merchant account. The settlement hits their bank account next day — exactly $100.

That’s the promise ForumPay just released. A payment flow that lets customers pay with Visa, Mastercard, or bank transfer, while the merchant receives crypto-converted fiat without ever touching the card network as a card acceptor.

Sounds like a loophole. Or an operational hack.

I’ve audited payment infrastructure before — 14 ICO whitepapers in 2017, 11 rejected for structural flaws. This one deserves a deeper look.

Context

ForumPay is a crypto-to-fiat payment processor. Merchants integrate their API, customers pay with any crypto wallet, and ForumPay instantly converts to fiat and settles to the merchant’s bank account. The merchant never holds crypto exposure. Standard stuff for the space.

What’s new: ForumPay now acts as the card-accepting entity on behalf of the merchant. The customer’s Visa/Mastercard payment is routed to ForumPay, which uses those funds to purchase crypto on the open market, then processes that crypto through its existing infrastructure — instant conversion, next-day settlement.

The merchant gets the invoiced amount. No chargeback risk. No compliance overhead. ForumPay passes the card processing fees to the customer at checkout. The merchant pays only ForumPay’s standard crypto processing fee.

That’s the pitch. But let’s stress-test it.

Core

Mechanically, ForumPay is inserting itself as a risk intermediary. The card network sees ForumPay as the merchant of record. Chargebacks hit ForumPay, not the end business. ForumPay must then absorb or contest those disputes using the crypto purchase as its hedge.

Here’s the order flow: Customer pays $100 via Visa → ForumPay receives $100 minus interchange fees (say ~2.5%) → ForumPay buys $97.50 worth of crypto at spot → Crypto is converted back to fiat via ForumPay’s liquidity pool → Merchant receives $100.

The math works only if ForumPay’s crypto conversion and settlement costs are less than the spread. ForumPay is essentially running a statistical arbitrage on the payment volume — similar to the 120-basis-point ETF arbitrage I executed in 2024. The difference: ForumPay carries the counterparty risk on every transaction.

If a chargeback occurs, ForumPay loses the principal plus the crypto volatility risk during the settlement window. They claim instant conversion, but “instant” in crypto still carries slippage on illiquid pairs.

From a merchant perspective, the value is clear: no chargeback management, no PCI audits, no multi-currency settlement headaches. But the merchant is now dependent on ForumPay’s solvency. If ForumPay gets hacked, frozen, or regulated out of existence, the merchant’s payment pipeline stops.

Verification precedes valuation; always.

Contrarian

The retail take: “Merchants can now accept cards without the pain.” The smart money question: “What regulatory landmine is being planted?”

ForumPay is operating in a gray zone. Card network rules require that merchants of record have proper registration, KYC, and dispute resolution frameworks. ForumPay is acting as a payment facilitator — but without the traditional licensing. Visa and Mastercard could change their bylaws to block this routing, or regulators could classify ForumPay as an unlicensed money transmitter in certain jurisdictions.

During the 2022 Terra collapse, I watched protocols that seemed “efficient” fail because they optimized for fees over legal structure. ForumPay’s model is elegant, but it concentrates risk: regulatory risk, liquidity risk, and operational risk in a single entity.

Systems, not sentiment, survive market crashes. This system needs a stress test. What happens when a major card issuer flags ForumPay’s transaction pattern as suspicious? What happens when a customer disputes a $10,000 luxury purchase and the crypto conversion happened at a volatile moment?

Takeaway

ForumPay is solving a real friction: merchants want more payment options without more complexity. This flow is a clever workaround. But workarounds have half-lives.

Efficiency through standardization. But standardization without legal foundation is just organized risk.

Forward-looking thought: If ForumPay survives the next regulatory wave, this model becomes the template for crypto payment infrastructure. If it doesn’t, merchants will learn the cost of trusting an unregulated intermediary.
